Red Solo Cups, an Inappropriate Witness, Fake Videos, and the Absolutely Inept trial of Karen Read. (Part 3, Jenn McCabe)


 

Once Trooper proctor became involved in the investigation of the murder of Boston Police Officer John O'Keefe, all objectivity went out the window.  There was nowhere else to turn at that point.   The Canton Police Department had been taken off the case due to a conflict of interest.  However, it is a mystery why Trooper Proctor wasn't ALSO conflicted off the case.  Karen's defense attorney David Yannetti summarizes the significance of this in the following quote taken from an article on NBCBoston.com:

"If Detective Sergeant Lank and Trooper Michael Proctor had been honest about their longstanding relationship with the Alberts, the grand jury would have been extraordinarily skeptical of this entire investigation, particularly given the fact that Detective Sergeant Lank and the Canton Police Department remained involved in the case in the hours and days discovering the agency was conflicted."

Don't forget that the victim was found in the snow on the front lawn of a home belonging to Brian and Nicole Albert.  The homeowners were present with the victim and Ms. Read the previous night at the Waterfall Bar in Canton.  The homeowners invited the victim and Ms. Read to an "after party" back at their house at 34 Fairview Rd in Canton, just 5 minutes or less from the Waterfall Bar.  Don't forget that these are the same homeowners who, after fire engines, ambulances, several police vehicles, and several witnesses were gathered directly outside their residence, claim they slept through the entire event until Jen McCabe snuck into their house and "bombed" into Brian and Nicole's bedroom waking them up.  

I say that Jen McCabe "snuck" in because while Canton Police Officer Saraf was testifying on cross examination, Defense Attorney Alan Jackson played a video and showed a figure entering 34 Fairview at approximately 6:30 am after just being near the victim, Ms. Read, and Ms. Roberts.  The video appears to show this person sneak around the back of one vehicle on to the driveway and up the first set of stairs on the side entrance to the residence.  All of this appeared to be unseen by anyone including responding police officers.  Officer Saraf called it an "oversight" while testifying on the second day of the trial.  Like I implied previously, the investigation was botched from Jump Street when the Canton Police began investigating.  This is one of several times during the immediate stage of the investigation where Jen McCabe is inexplicably inserted in it.  She controlled the entire narrative written by responding officers and by the Commonwealth in their statement of the case:  

"Ms. McCabe observed Ms. Read walk into the bar holding a glass cup from C.F. McCarthy's with a clear liquid inside that she believed was a vodka soda drink."  This is mentioned so frequently that you would think it is evidence that Karen is psychopath and killed her boyfriend with a cocktail glass.  However, it was one of the first things mentioned by Jen that painted Karen in a negative light.

While inside the residence following her arrival there, Ms. McCabe observed a black SUV, consistent with Ms. Read's vehicle, a 2021 black Lexus SUV, arrive in front of the residence, from her vantage point at the front door of the home. Ms. McCabe texted Mr. O'Keefe at 12:31 a.m., stating "Hello."  What Jen saw and where the vehicle was positioned have become  a focal point for teh Commonwealth during the trial thus far.  

At approximately 4:53 a.m., Ms. McCabe stated that she received a phone call from Ms. Read looking for Mr. O'Keefe.  The defendant told Ms. McCabe that she last remembered seeing the victim at the Waterfall Bar. Ms. McCabe then informed the defendant that she observed the defendant and the victim leave the bar together. Ms. McCabe also later informed the defendant she had seen them in Ms. Read's vehicle in front of the home on Fairview.   The narrative surrounding Karen's level of intoxication has always been a mystery to me.  She is seen on video drinking several drinks over the course of 3+ hours.  At no point on surveillance video does she even give a HINT of intoxication and several of the bar patrons have already testified that Karen did not seem intoxicated.  Now I don't doubt the possibility that Karen may have had more drinks when she went home but, according to a Commonwealth expert, her BAC could have been up to .29 when her blood was drawn at Good Samaritan Hospital in Brockton later in the morning.  I think this is an early example of the Commonwealth or Jen McCabe to make Karen look more guilty than she actually is.  

Ms. McCabe stated that the victim was lying on his back covered with approximately six inches of snow, with his phone on the ground underneath him. The defendant yelled at Ms. McCabe twice to Google, "How long do you have to be left outside to die from hypothermia?"

This is where it gets interesting!
